Cancellation and Refund Policy
1. INTRODUCTION
This Cancellation and Refund Policy applies to the web design and monthly maintenance services offered by Orvenx Tech ("we," "us," "our") to our clients ("you," "client"). By contracting our services and making a payment, you agree to the terms set forth below.
2. INITIAL PAYMENTS (WEBSITE)
The initial payment for the design and development of your website (e.g., $1,200 USD or $1,500 USD) covers the planning, design, technical setup, and launch of the site. Due to the creative nature of the work and the time invested from the start of the project, this initial payment is non-refundable once the design work has begun.
3. MONTHLY MAINTENANCE ($199 USD/month or $299 USD/month)
The monthly maintenance service includes, but is not limited to, minor content updates, basic security monitoring, regular backups, and basic technical support. Monthly payments already made are non-refundable. If you decide to cancel the service, the cancellation will apply to future months, not the month already paid for.
4. CANCELLATION NOTICE
You can cancel your monthly maintenance plan at any time by providing written notice (e.g., by email) at least 30 days in advance. Upon receiving your notice, we will stop automatic charges after the current billing period.
5. WEBSITE OWNERSHIP AND ACCESS AFTER CANCELLATION
The content and design of the website created for you will become your property once all agreed-upon payments have been made. When you cancel the monthly maintenance plan, your site may remain active on the server where it is hosted, but:
- We will stop making changes, updates, and backups.
- We may remove our administrative access to your site and related accounts, while maintaining your access as the owner.
6. DOMAIN AND HOSTING
The website's domain name will be registered and maintained in the client's name, who will be its legal owner. Orvenx Tech will act solely as the technical administrator of the domain and, when necessary, will manage its configuration and renewals on behalf of the client.
In the event of cancellation of the monthly maintenance service, the domain will remain the property of the client. At the client's request, Orvenx Tech will provide any information reasonably necessary (e.g., transfer codes or instructions) so that the client or their new agency can continue managing the domain and hosting.
The client will be responsible for the costs of renewing the domain and hosting, either directly with the provider or through Orvenx Tech if so agreed. If renewal payments are not made on time, Orvenx Tech will not be liable for domain expiration or website service interruptions.
7. CANCELLATION BY ORVENX TECH
We reserve the right to cancel or suspend service in the event of a serious breach of these terms, misuse of the website, or non-payment. In such cases, we will make reasonable efforts to notify you in advance and, if possible, give you the opportunity to rectify the situation before suspension.
8. CHANGES TO THIS POLICY
We may update this Cancellation and Refund Policy periodically. The current version will always be available on our website. Your continued use of our services after any changes constitutes your acceptance of the updated policy.
